BY USING ANY FX DESIGN GROUP, LLC, FX SCENERY AND DISPLAY, LLC OR FX LIGHTING, LLC (“FX”) WEB SITE OR SHARING PERSONAL INFORMATION WITH FX, YOU ACKNOWLEDGE THE POLICY BELOW AND AGREE TO BE BOUND BY ITS TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO ANY PART OF THIS POLICY, YOU MUST STOP USING ALL FX WEB SITES AND SERVICES IMMEDIATELY.

This FX Statement of Privacy applies to FX family of Web sites and governs data collection and usage at all FX sites and services as well as collection of personal information via postal mail, fax, telephone, in person or any other method. Please read the FX Statement of Privacy below and also any supplementary information at the end of this statement for additional details about particular FX sites and services that you may use.

FX sites are general audience Web sites, intended for users of all ages. Personal information of all users is collected, used and disclosed as described in this Statement of Privacy. This statement also contains a section with specific details regarding personal information collected from children.

Collection of your personal information
FX collects personal information, including but not limited to, your e-mail address, name or work address or telephone number. FX may also collect demographic information including but not limited to your ZIP code, age, gender, preferences, interests and favorites. Information collected by FX may be combined with information obtained from other FX services and other companies.

FX also collects certain information about your computer hardware and software. This information may include: your IP address, browser type, domain names, access times and referring Web site addresses. This information is used by FX for the operation of the service, to maintain quality of the service and to provide general statistics regarding use of FX Web sites.

FX keeps track of the pages our customers visit within FX sites, in order to determine what FX sites and services are the most popular. This data is also used by FX to deliver customized content and advertising messages to customers whose behavior indicates that they are interested in a particular subject area.

FX encourages you to review the privacy statements of Web sites you choose to link to from FX sites so that you can understand how those Web sites collect, use and share your information. FX is not responsible for the privacy statements or other content on Web sites outside of the FX family of Web sites.

FX may also collect personal information via promotions such as contests, drawings or trade show “fish bowls.” These promotions may or may not be Web-based, but still fall under this policy.

By contacting FX via the Internet (including e-mail and Web forms), postal mail, telephone, in person or any other communication method, you may receive occassional promotions or messages via e-mail, postal mail, telephone or fax in the future. You may discontinue e-mail, fax and telephone communications by following the instructions provided within the communication. Please note, however, that contacting FX by any other method in the future may result in us resuming communication with you, even if you have previously opted out of any or all communication from us.

Use of your personal information
FX uses information for the following general purposes: to customize the advertising messages and content you see, advertise and market products and services, fulfill your requests for products and services, improve our services, contact you, conduct research and provide anonymous reporting for internal and external clients.

FX and its operational service partners collect and use your personal information to operate FX and deliver the services you have requested. FX also uses your personal information to inform you of other products or services available from FX and its affiliates. FX may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered.

FX may occasionally hire other companies to provide limited services on our behalf, such as handling the processing and delivery of mailings, providing customer support, processing transactions or performing statistical analysis of our services. FX will only provide those companies the personal information they need to deliver the service. Personal information collected on this site may be stored and processed in the United States or any other country in which FX or its affiliates, subsidiaries or agents maintain facilities, and by using this site, you consent to any such transfer of information outside of your country. FX abides by the safe harbor framework as set forth by the U.S. Department of Commerce regarding the collection, use and retention of data from the European Union.

FX may not rent, sell or share personal information about you with other people or non-affiliated companies except to provide products or services you’ve requested, when we have your permission or to provide information to trusted partners who work on behalf of or with FX under confidentiality agreements.

In addition, FX may disclose your personal information is certain circumstances, including but not limited to:

  • To respond to subpoenas, court orders or legal process or to establish or exercise our legal rights or defend against legal claims.
  • If FX believes it is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our terms of use or as otherwise required by law.
  • If FX is acquired by or merged with another company. In this event, we will notify you before information about you is transferred and becomes subject to a different privacy policy.

Control your personal information
You may stop the delivery of future promotional e-mail from FX or an FX Web Property by following the specific instructions in the e-mail you receive.

Please note, however, there are some FX services that send out periodic e-mails informing you of technical service issues, product surveys, new feature announcements and news about FX products and services. You may not be able to unsubscribe to these mailings, as they are considered a part of the service you have chosen.

Security of your personal information
FX is committed to protecting the security of your personal information. We use a variety of security technologies and procedures to help protect your personal information from unauthorized access, use or disclosure. For example, we store the personal information you provide on computer systems with limited access that are located in controlled facilities. However, FX and third-parties working on our behalf cannot guarantee the security of confidentiality of your personal data.

Forum privacy information
FX maintains an interactive forum that allow users to participate in virtual discussions. Any information posted to this forum is available to the general public. Before posting, carefully consider any consequences of posting your material. FX will not be responsbile for the results of your use of the forum.

Collection and Use of Children’s Personal Information
FX sites are intended for users of all ages.

Children under the age of 13 must receive a parent or guardians’ permission before providing data or personal information to FX.

However, FX cannot be responsible for children under the age of 13 that provide an incorrect age or who forge or otherwise alter parental permission forms.

Use of cookies
FX and contracted third-party provides may use “cookies” to help you personalize your online experience and track general Web site usage data. A cookie is a text file that is placed on your hard disk by a Web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a Web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time. For example, if you personalize FX pages, or register with FX sites or services, a cookie helps FX to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses and so on. When you return to FX, the information you previously provided can be retrieved, so you can easily use the FX features that you customized.

You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer. If you choose to decline cookies, you may not be able to fully experience the features of the FX Design Group, LLC services or Web sites you visit.

Use of  Web beacons
FX Web pages may contain electronic images known as Web beacons — sometimes called single-pixel GIFs — that allow FX and its contracted third-party providers to count users who have visited those pages and to deliver co-branded services. FX may include Web beacons in promotional e-mail messages or FX newsletters in order to count how many messages have been opened and acted upon. Web beacons are not used to access your personal information on the FX network of sites and services; they are a technique we use to compile aggregated statistics about FX Web site usage.

Web beacons collect only a limited set of information including a cookie number, time and date of a page view and a description of the page on which the Web beacon resides. FX Web pages may also contain Web beacons placed there by our advertising partners to help determine the effectiveness of our Internet advertising campaigns.

Enforcement of this statement of privacy
If you have questions regarding this statement, you should first contact FX via postal mail.

Timing of information removal
It may take up to approximately 2-3 weeks for removal requests to become active. FX often plans marketing campaigns in advance using third-party services or vendors and cannot always make immediate changes to these campaigns, though we make every effort to comply with removal requests as quickly as possible.

Changes to this statement
FX will occasionally update this state to reflect company needs and customer feedback. When FX posts changes to this statement, you will see the word “updated” next to its link on the front page of FX. FX encourages you to periodically review this statement to be informed of how FX is protecting your information.
